Refugee protection

The following sections contain information on the most important international treaties and agreements of which Cuba is signatory, as well as national legislation relevant to the protection of refugees.
The Cuban state is not a signatory to the 1951 Convention relating to the status of Refugees or its 1967 Protocol. Moreover, Cuba has also not signed the 1954 nor the 1961 Convention relating to the Status of Stateless Persons.
There is no legal framework or national mechanism for determining refugee status or for the protection of refugees. The office of the United Nations High Commissioner for Refugees (UNHCR) carries out these procedures for those who request international protection in Cuban territory.

ORAM is a non-profit organisation whose efforts are focused on the protection of vulnerable refugees and asylum seekers by the international community. It provides information and advice to the most vulnerable asylum seekers and refugees seeking recognition of their legal status, international protection and resettlement in a third country. Works to provide protection to those who are at higher risk of harm and violence and need urgent help, such as children, gender and sexual minorities, victims of torture, single women with children, victims of human trafficking, people with disabilities, the elderly , people with diseases that threaten their health and all those who face attacks in their city of refuge.

Oxfam is particularly active in the eastern provinces of Cuba. They work with local research centres and associated organizations to expand their achievements and those of the community by promoting participation in sustainable food production and distribution, equal gender rights and minimizing the risks associated with natural disasters.

Spanish Solidarity with Cuba is an NGO founded by a group of young Spaniards who try to show solidarity with the Cuban democrats and their families, being aware of the cultural and historical ties that the Spanish people have with Cuba. Activists fighting from within Cuba for peaceful changes towards democracy and their families find themselves in a particularly difficult situation.
